Gee! Wasn't STREAMS the (obsolete) networking technology that Caldera tried unsuccessfully to have placed into Linux, and that TSCOG is now whining was illegitimately placed there anyway, even though it wasn't?

Here, at the LKML and from all the way back in 1998, is Alan Cox' wonderful treatise on just exactly *why* STREAMS never made it into the Linux kernel.

It is interesting to note that Amendment No. 2 makes reference to
Amendment X, but that Amendment X makes *no* reference to Amendment
No. 2.

The reference in Amendment No. 2 is in "D." section, and is fairly
much boilerplate:

"Novell and SCO agree to indemnify and hold harmless the other from
and against any and all losses, liabilities, judgments, and costs
incurred ("Liability") if either causes the other to incur Liability
under Section 10 of Amendment No. X to Software Agreement SOFT-00015
as amended, Sublicensing Agreement SUB-00015A as amended, Software
Agreement SOFT-00015 Supplement No. 170 as amended, and Substitution
Agreement XPER-00015B ("Amendment No. X")."


This suggests that either:

1) Amendment No. 2 was executed after Amendment X, and thus 2 knew of
X, while X could not know of 2, as it were; or

2) Amendment No. 2 was a side deal between Novell and the Old SCO, and
had *nothing* to do with IBM at all. This, of course, is confirmed by
the fact that Amendment No. 2 is signed only by Sabath (for the Old
SCO) and Tolonen (for Novell), while Amendment X is signed by both
those two and by Craig Schneider for IBM


This has always been my opinion: Amendment No. 2 was some sort of a
side deal where Novell nailed down various SysVRX license/licensee
issues, and threw the copyrights bone in paragraph A. to the Old SCO
as a quid-pro-quo...

Curious note:

Amendment No. 2 makes reference to "Substitution Agreement XPER-00015B
("Amendment No. X")" and thus equates XPER-000015B with Amendment X.

All results returned [at Sun Oct 24 02:18:34 PDT 2004] (with the
exception of Amendment No. 2 at sco.tuxrocks) reference "the
Substitution Agreement (Agreement Number XPER-00015B) dated February
1, 1985."

Why is Amendment No. 2 seemingly equating a document from February 1,
1985, with Amendment X, dated October 16, 1996?

Even Amendment X refers to XPER-00015B in the correct context:

"Amendment No. X to Software Agreement SOFT-00015 as amended,
Sublicensing Agreement SUB-00015A as amended, Software Agreement
SOFT-00015 Supplement No. 170 as amended, and Substitution Agreement
XFER-00015B"

APA_analysis.html

This represents a subset of the Asset Purchase Agreement (APA) between the Santa Cruz Operation and Novell, dated September 19, 1995

The basic approach is to present, with inline commentary, the APA as it presents the "Business"; the schedules "Assets" and "Excluded Assets" and other supporting documents are inserted inline where they seem to fit into the logic of the APA. Also included is Amendment No.2, dated October 16, 1996, and some of the Missing Schedules, as needed.

The intent is to try and follow through the APA and discover just exactly where and just exactly what was transfered from Novell to the Old Santa Cruz Operation. There is probably a particular emphasis on "Copyright", and a lesser emphasis on "Trademark".

Inline is some background, some non-exhaustive analysis, and a few relevant links outward.

Of the two, this is the more current document, and the one being actively revised and updated.

This represents a more straight-up rendition of the APA, with the schedules "Assets" and "Excluded Assets" inserted inline where they are either first mentioned, or are relevant for understanding. Also included inline is Amendment No.2, dated October 16, 1996.

Of the two, this document is pretty much static at this point, as my efforts have gone into the Analysis.

UNIX obscurities..
/DOSystems/XINU.html - "Xinu" is used to name two entirely different Unix variants. *This* Xinu is another teaching OS (written by Douglas E Comer, now at Purdue), in the sense of Minix, and is probably not a "real" Unix.
Another Xinu is Mt Xinu (Mt Xinu == Unix tm backwards :-) ) Mt Xinu came out of Berkeley: "Berkeley, Calif.-based Mt Xinu, founded in 1982, specializes in the development, marketing and support of leading-edge UNIX system software for research, development and educational applications." and was an actual Unix variant.
